Terms of Service

These terms describe the current rules for using Your Baby's a Genius. Film Assist, LLC presently operates the service and sells direct products. Please review these terms before creating an account or purchasing.

Operator, eligibility, and agreement

Film Assist, LLC currently operates Your Baby's a Genius and is the seller for direct site-created products. Indigetech World Wide, LLC is planned but is not currently the operator or merchant. By creating an account, purchasing, or using protected services, you agree to these terms and the Privacy Policy. If you do not agree, do not create an account or purchase.

  • Accounts, checkout, support, and protected access are for adults who can form a binding agreement.
  • A parent, legal guardian, educator, or other responsible adult must supervise a child's use of activities and materials.
  • You are responsible for accurate account information and for keeping credentials and reset links private.

Educational and safety boundaries

The service provides general educational information and family-learning ideas. It does not diagnose, treat, or prevent a condition; replace prenatal, pediatric, developmental, mental-health, therapeutic, legal, or educational advice; or guarantee intelligence, milestones, grades, income, or any other outcome.

  • Choose activities and products for the individual child's age, abilities, allergies, environment, and needs.
  • Follow manufacturer warnings and use appropriate adult supervision, especially with small parts, movement, food, water, tools, screens, or outdoor activities.
  • Stop or adapt an activity that is unsafe, distressing, inaccessible, or inappropriate and seek qualified guidance when needed.

Direct purchases, Stripe, and access

Site-created EBooks, memberships, tools, and other direct products are managed through the Products system and are planned to use Stripe-hosted checkout. The offer shown at checkout controls the product, price, currency, included access, billing basis, and delivery status. Access is granted only after a verified payment or an authorized account grant.

  • Do not bypass checkout, entitlement, account, or protected-download controls.
  • Keep order confirmations and verify that your email address is correct before purchasing.
  • Membership features, content, and availability may evolve, but we will not knowingly describe an unavailable feature as currently delivered.
  • Refund eligibility is governed by the posted Refund Policy and any non-waivable consumer rights. The final refund window must be approved before live checkout.

Amazon affiliate recommendations

Some reviewed products link to Amazon rather than our checkout. Those links may earn Film Assist, LLC a commission from qualifying purchases at no additional charge imposed by us. Amazon—not Film Assist—sets the external price and availability and handles the Amazon order, payment, shipping, returns, and customer service.

  • An Amazon recommendation is not a Your Baby's a Genius direct product, membership entitlement, or internal affiliate payout.
  • The required Amazon Associate disclosure appears near published recommendations.
  • A recommendation is educational editorial content, not a warranty that a product is suitable for every child or circumstance.

License and intellectual property

Unless an offer states otherwise, a completed direct digital purchase grants the purchasing adult a limited, personal, non-exclusive, non-transferable license to use the delivered materials within that adult's household for lawful, noncommercial family learning. Ownership of the materials and underlying intellectual property is not transferred.

  • Do not resell, publicly distribute, upload, publish, sublicense, remove ownership notices from, or provide shared download access to protected materials.
  • Do not copy substantial portions to create a competing product, dataset, course, membership, or service.
  • Educators, libraries, organizations, and businesses need an approved institutional or commercial license before broader distribution.

Acceptable use

Use the service lawfully and in a way that respects families, creators, systems, and other users. We may investigate misuse and restrict access when reasonably necessary to protect the service, customers, or legal rights.

  • Do not attempt unauthorized access, probe security, introduce malicious code, scrape protected material, automate abusive traffic, or interfere with availability.
  • Do not impersonate another person, use a child's identity for an adult account, submit unlawful or harmful material, or misuse support.
  • Do not use the site or its name to make misleading medical, developmental, educational, earnings, sponsorship, or endorsement claims.

Availability, changes, and account action

We may maintain, improve, replace, or discontinue features and may correct errors in descriptions or availability. Draft, coming-soon, and preorder concepts are not current deliverables unless the offer expressly says otherwise. We may suspend or close an account for material misuse, fraud, chargeback abuse, security risk, or violation of these terms, subject to applicable law and any required access or refund obligations.

Third-party services and links

Stripe, Amazon, email, hosting, and other providers have their own terms and privacy practices. We are responsible for our service and representations, but we do not control an external service's inventory, uptime, policies, or actions. Review the external provider's terms before using it.

Disclaimers, responsibility, and consumer rights

The service is provided with the care described in our public standards, but online services and educational materials cannot be guaranteed error-free or continuously available. To the extent permitted by law, Film Assist, LLC is not responsible for indirect or consequential loss caused by misuse, an external provider, or reliance on general information as individualized professional advice. Nothing in these terms excludes warranties, remedies, or other rights that cannot legally be waived.

Changes, future operator, and contact

We may update these terms as the service, products, providers, or legal operator changes. Material changes should receive a new effective date and, when appropriate, notice to account holders. A future transfer to Indigetech World Wide, LLC or another successor will not be represented as complete until the legal, payment, bank, tax, privacy, and customer-facing records have actually changed. Use Support for account, purchase, accessibility, policy, or legal-notice questions.

  • The governing-law, venue, dispute-resolution, formal notice address, supported selling regions, and final refund language require approval before live checkout.
  • If any provision conflicts with a non-waivable law, that law controls to the extent of the conflict.

Entire agreement and severability

These Terms, the Privacy Policy, the Refund Policy, and the specific offer presented at purchase form the current agreement for the service and direct product. If a provision is found unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce one provision is not a waiver of another.
